These terms are an agreement between you and NextPhase Labs LLC ("we", "us"), 418 Broadway, STE R, Albany, NY 12207, for using the I'm Drunk apps and this website (together, "I'm Drunk"). By using I'm Drunk, you agree to them. If you don't agree, please don't use it.
01Who can use it
You must be at least 18 years old, and of legal drinking age where you live, to use I'm Drunk. You're responsible for following the laws that apply to you.
02What I'm Drunk does
I'm Drunk lets you set a lock while you're sober. Until the time you choose, it blocks the apps you pick (such as Messages, social apps and FaceTime) and gives you call buttons for your buddy and a few chosen contacts. Ride apps like Uber and Lyft stay open. Your buddy can end a lock early with a one-time code, or from their own I'm Drunk app if they've linked it.
- On iPhone, Apple doesn't let any app block the Phone app, so calls stay possible during a lock.
- On Android, outgoing calls are blocked during a lock except to your buddy and saved contacts. Emergency calls are never blocked.
03It's a tool, not a guarantee
I'm Drunk relies on features of iOS and Android that we don't control. A lock can fail, end early or not start, for example after a system update, a restart, a change to your phone's settings, or if someone with your passcode turns it off. We don't promise that I'm Drunk will stop every message, call or post. You're responsible for what you send, post and do, with or without a lock.
04Your buddy
Your buddy is someone you choose and trust. They aren't our employee or agent, and we aren't responsible for whether, when or why they unlock your phone. Only add people who've agreed to be your buddy or contacts, and keep their details private.
05Drink responsibly
I'm Drunk helps you avoid messages you'll regret. It doesn't make drinking safe, doesn't measure how much you've had, and isn't medical, legal or safety advice. Never drink and drive. If you or someone else is in danger, call 911 or your local emergency number.
06Acceptable use
Don't use I'm Drunk to harm, harass or control anyone else, including installing it on someone else's phone without their permission. Don't try to reverse engineer, resell or misuse the apps or this site, or interfere with how they work.
07Price, Premium and changes
The lock, buddy unlock, ride buttons and calling your buddy are free. I'm Drunk Premium adds extra features and is sold in the app as a monthly or yearly subscription or a one-time lifetime purchase, at the price shown before you buy. Purchases are made through the App Store or Google Play under their terms.
- Renewal: subscriptions renew automatically at the end of each period unless you cancel at least 24 hours before it ends. You're charged through your Apple or Google account.
- Free trial: if a plan comes with a free trial, you're charged when the trial ends unless you cancel before then.
- Cancelling: manage or cancel in your iPhone's Settings (your name, then Subscriptions) or in Google Play (Payments & subscriptions). Premium stays on until the end of the period you paid for.
- Refunds: Apple and Google handle refunds under their own policies.
Founding 1,000. The first 1,000 people on the beta waitlist who sign in to the app with the same email get 12 months of Premium free. At launch we'll email founders the date their 30-day claim window closes; spots not claimed by then go to the next people on the waitlist who sign in. The free year needs no payment details and never turns into a paid subscription on its own. When it ends, founders can keep Premium for $9.99 a year by subscribing in the app. One spot per person and per email; it can't be transferred or exchanged for cash.
We may change prices for future periods (you'll be told before a change applies to you), and we may change, pause or stop I'm Drunk or any feature at any time.
08Beta
Beta versions are early and may have bugs. They're provided for testing and feedback, and may change or stop working without notice.
09Our stuff
I'm Drunk, its name, logo, design and code belong to NextPhase Labs LLC. We give you a personal, non-transferable right to use the apps on devices you own or control, under these terms and the App Store or Google Play rules. If you send us feedback, we may use it without owing you anything.
10App stores
If you got the app from the App Store or Google Play, their terms apply too. Apple and Google aren't responsible for I'm Drunk or for supporting it; we are. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
11No warranties
I'm Drunk is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement, and we don't warrant that it will be uninterrupted, error-free or effective at preventing any message, call or other action.
12Limit on our liability
To the fullest extent the law allows, NextPhase Labs LLC won't be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, relationships, reputation or profits, arising from your use of I'm Drunk or any message, call or action it did or didn't stop. Our total liability for any claim is limited to the greater of the amount you paid us for I'm Drunk in the 12 months before the claim, or $50.
Some places don't allow these limits, so they may not all apply to you.
13Indemnity
If someone brings a claim against us because of how you used I'm Drunk or broke these terms, you agree to cover our reasonable costs, including legal fees, to the extent the law allows.
14Ending
You can stop using I'm Drunk any time by deleting the app. We may suspend or end your access if you break these terms. Sections 3, 5 and 9 to 16 keep applying after that.
15Governing law and disputes
These terms are governed by the laws of the State of New York, without regard to its conflict-of-law rules. Any dispute will be handled in the state or federal courts in Albany County, New York, and you and we agree to those courts' jurisdiction. Before filing anything, please email us so we can try to sort it out.
16Changes to these terms
We may update these terms. We'll change the date at the top, and for significant changes we'll give notice in the app or on this site. Using I'm Drunk after a change means you accept the new terms.
